For the purpose of this document, Put Me On The Web could also be referred to as "we", "us", "its", "it", "our".
The Customer (aka the Client) could be referred to as "you", "your", "he", "she", he/she", "his, "her", "his/her", "their", "him", "her", "him/her", "they".

1. Service

Any Breaches of any of the Terms and Conditions, as detailed below, by the Customer may result in suspension, termination, and/or limitation of Services. In most circumstances, a refund will neither be granted and nor carried out.

Put Me On The Web agrees to provide the client the Service the client has paid for either as a separate Service or as one included in a package and/or deal. This includes website design, hosting, add-ons/extras, and technical support.

The Customer agrees to pay Put Me On The Web the correct prices and fees for the work which we will endeavour to carry out. Payment will be made before the work is carried out, unless prior arrangement(s) has/have been made between us and the customer.

Put Me On The Web will endeavour to ensure a prompt, professional, and continuing Level of Service, will not be held liable in any loss of data resulting from delays, non-deliveries, caused by circumstanced out of our control or indeed by the aformentioned caused by the Customer and his/her actions.

The Customer has a right to ask for reasonable changes to be made once the website has been designed, before it is published on the Web. It is understood by us that amendments, modifications, additions, and subtractions may take place post-design, to fit in with the Customer's wishes and/or concept of what their website may have looked like and/or will look like after designing. However, if we that the Customer is abusing the situation in terms of the amount and frequency of the changes asked for by him/her prior to uploading the site to the Web ('going live'), then we may take steps to resolve the situation which could result in cancelling the contract with the Customer and to possibly consider part-refunding him/her.

There will be times when Put Me On The Web (its websites, its hosting etc...) may be taken-off for routine repair, upgrades, maintenance for example. We will endeavour to notify the Customer giving him/her as much warning time, but there will be occasions when this is not possible. Consequently, we cannot be held responsible and/or liable for those times. We cannot also be held responsible and/or liable for loss of data transfer, sites being temporarily offline, as well as loss of business/earnings suffered by the Customer during this period. In addition, we cannot be held responsible and liable for unscheduled downfalls in the Internet and/or its hosting facilities due to adverse weather, network failure, maintenance by Internet companies, power failure, as well as Governmental organisations.

The Customer understands and agrees that Put Me On The Web will design a website for him/her and/or his/her company , and as a result to register a domain name accordingly. In doing so, this does not constitute a guarantee by us that by having such a domain name (or domain names) and/or such a website (or websites), and/or consequently being in the Search Engines, this will increase the Customer's business and/or presence on the web. Thus, we cannot be held responsible if the aforementioned does not take place.

2. Intellectual Property Rights

The Customer understands and agrees that he/she has no rights over the website designed, and that the copyright remains with Put Me On The Web. All information supplied by the Customer will remain the copyright of the Customer (or 3rd Party), however, the design, typsetting, graphics, flash animations (indeed anything created by us during the design of the website) will remain the copyright of Put Me On The Web. We also reserve the right to put a banner on any of the sites we has designed, linking them back to our website and/or any other sites in our control.

The Customer will not be allowed to take the website designed for him/her to another hosting company, unless we agrees to release the copyright (upon payment of a fee). The copyright release fee will be the cost of the package purchased by the customer, as well as any extras and/or add-ons purchases, and any other fees incurred by the Customer as a result of work carried out on the website during the contractual period). The Customer will then have complete rights over the site to do as he/she wishes. These rights will include the design, any work carried out on the website, flash animations, logos, and forms. Put Me On The Web will make a copy of the website (usually by CD) and will send this to the Customer, when payment has been made, along with a letter from us acknowledging release of copyright to the Customer.

3. Usage and Liabilities

The Customer will abide by local and national British Laws in relation to his/her contract with Put Me On The Web. The Customer shall not use the Service to receive or transmit material which is in violation of any law or regulation, which is obscene, threatening, menacing, offensive, defamatory, in breach of confidence, in breach of any intellectual property (including any Trademark and/or Copyright). This extends to violations due to any spamming and or bulk email activity for which we may seek legal action. This condition is also in accordance with the conditions stated in the Hosting, Control Panel And E-mails section of this document.

The Customer will keep all usernames, passwords, and access information secure, and will not share these details with unauthorised 3rd parties unless we agrees to such Parties. The Customer will take reasonable precautions with such information, but in the event this information should be known to unauthorised 3rd Parties, the Customer must inform us immediately. We cannot be held liable for loss of data and/or changings in settings resulting in unauthorised access, prior to being notified by the Customer.

The Customer shall be responsible for all liability regarding costs to Telephone/Broadband Companies for their point of connection (for example to connect to his/her Control Panel, FTP etc...), and Put Me On The Web cannot accept responsibility if the Customer cannot access his/her website(s) due to such companies placing restriction on the Customer's service for whatever reasons.

The Customer also understands and agrees that Put Me On The Web does not exercise any control over the content and information sent across the Internet, including connection to other networks and/or computers across the Internet.

4. Support

Support will be given to customers who have a paid for a service (a website package plus addons/extras, and/or a stand-alone hosting package) via e-mail, telephone, fax, or post. Other methods will be at the discretion of Put Me On The Web.

Support is offered on the Put Me On The Web website, and it is advisable that customers use this as a first method of contact with Support. There may be times when this method is unavailable, and Put Me On The Web cannot be held liable if the Support System goes offline or is unavaible for whatever reason. It is suggested that the Online Support method is used first of all when requesting for technical support.

Support will only be given for technical issues regarding websites and hosting. This does not include websites or scripts (et a)l created by customers and/or other design companies, where Put Me On The Web is simply offering hosting to the customer. If we were directly involved in the design of the website, its facilities (e-mail, Control Panel etc...), then Put Me On The Web will have a duty to the customer to solve the problem(s) he/she brings to our attention. If after reasonable attempts have been taken to resolve the matter(s) the issue(s) still remain(s), refunds may be given at our discretion.

Support may be given outside of normal business hours (evenings and weekends) at the discretion of Put Me On The Web - it may be that normal business hours may not be suitable for a particular issue or issues. The Customer has the choice of replies to his/her Support Query which includes e-mail, telephone, fax, and post, and Put Me On The Web will try to adhere to the Customer's choice. There may be times, however, when this is not possible, and we may have to use a diferent method of communication to that chosen by the Customer.

5. Fees, Payments, Renewals, and Cancellations

Fees, payments, and renewals can be paid for via Credit/Debit card, Cheque, Postal Order, and Cash. Put Me On The Web does not advise the Customer to send cash, and we cannot be held responsible for non-receipt of payment using postal methods.

All fees and payments are non-refundable once the work has been carried out. In the matter of Domain Name Registration, once domain names have been registered, those fees cannot be refunded (even if the Customer changes his/her mind), as we have had to pay registry fees to secure the Domain Name - this includes changes of names or extensions, for which an additional fee will be charged to cover administration and registry fees.

Fees paid for Search Engine Submissions (aka SEO) are also non-refundable unless the work was not fully carried out by Put Me On The Web. Optimisation such as keyword/keyphrases (metatagging), titles of webpages and descriptions of webpages count as work carried out. We will not be held liable and/or responsible for rankings (this includes the changes in ranking) within the Search Engines or as to when the customer's website will appear in the Search Engines, as this is determined by the Search Engines themselves, for which we have no control over and/or dealing with them.

Renewals will not take place automatically each year, and it is the responsibility of the Customer to ensure that they contact us to notify us if they wish to renew their contract with us. If payment and/or fees have not been received in time, we has the right to terminate or to temporarily suspend thei Account and/or Services, and to remove their website(s) from the Web ('taking down').

The Customer has the right to withdraw and/or cancel their Agreement and/or services paid for with Put Me On The Web. Cancellations for webdesign packages MUST be made in writing (by post or fax) within 7 DAYS of the order payment. This is in accordance with the information as set out in the Office of Fair Trading website.

Cancellations for Services such as add-ons, extra domain names, enquiry forms etc... MUST also be made within 7 DAYS. However, if work has started on the Service or the Service was completed before cancellation was advised, then Put Me On The Web reserves the right to refund (in part or in full) the Customer.

Due to the fact that Domain Names have to be registered and paid for at the time of registration, no refunds can made for any Domain Names registered (whether singularly or as part of a website package). However, this registration fee (plus an Administration Fee or 10% of the value of the Domain Name) will be deducted from any payments made by the Customer at the time of ordering, and the remaining amount refunded back to the Customer via their method of payment (or equivalent).

6. Hosting, Control Panel, And E-mails

Put Me On The Web shall offer two types of Hosting. The first type is automatically part of any of the packages offered. The second type is for the Customer who wishes to have a site predesigned to be hosted.

In both instances, Put Me On The Web agrees to host the Customer's website(s). The Customer will not to publish any material deemed indecent, immoral or illegal under British Law. This includes child and adult pornography, and any sites promoting racism, terrorism, spamming and any other kind of hatred. Put Me On The Web does not create or host websites of an adult nature, regardless of the current Law, neither will it allow its name to come into disreputation because of the contents of its websites or the websites (and domain names) it hosts. We will not be held responsible and/or be liable should the Customer breach his/her contract due to the aforementioned.

In the instance that the Customer has bought a Hosting Package or that the Customer has been given access to his/her webspace (upon payment), the above condition is also valid. In addition, theCcustomer will not upload, store, and give access to any material deemed indecent, immoral or illegal under British Law (such as music, films, or any item(s) under Copyright). Should the Customer wish to upload and store files, then he/she will be allowed to do so providing her/she holds the copyright for these items. However, we will not check this with the Customer, therefore the Customer has full liability.

The Customer will not use his/her Hosting Account, Control Panel (if applicable), and/or e-mail addresses to spam 3rd Parties, to access other people's accounts and hosting (including 3rd Party), or to cause general nuisance to 3rd Parties. The Customer will also not use his his/her Hosting Account, Control Panel (if applicable) or any other means to hack into anyone's systems, including Put Me On The Web's systems. In doing so, this will be treated as a Breach of Contract as well as a legal matter, and legal action may be taken against the Customer. In addition, termination will normally preceed this course of action.

7. Domains and Domain Name Registrations

Put Me On The Web agrees to purchase and register a domain (or domains) on behalf of the Customer (upon payment either by package deal or separately), and to charge administration and registry fees accordingly to the Customer. By purchasing the domain(s), the Customer gives authority for us to administer the domain(s) unless the domain(s) are transferred out of our control (for which an administration fee is payable). The domain(s) will also be registered in the Customer's name, unless we agree with the Customer to do so otherwise.

Fees for domains will be charged for registration and transferring the domain out from Put Me On The Web. Fees for registering domain names are non-refundable, as a part of the fees for registration includes a Registry fee.
